Overview

The Martin Law Group, LLC is dedicated to helping employees and their loved ones with employee benefit problems. These problems include an insurance company refusing to pay a long term disability benefit claim for someone, disagreements with pension calculations, refusal to pay a retirement benefit, refusal to pay life insurance benefits, or problems obtaining COBRA insurance coverage. All of these problems arise out of a benefit provided to an employee in the workplace. Most of these problems are governed by the Employee Retirement Income Security Act of 1974 or ERISA for short.

ERISA is a very complex and difficult statute, which has been made more challenging for employees over the years. For example, many benefit policies contain a provision requiring that a court only reverse an insurance company's decision when it is found to be not just wrong, but also unreasonable. This has caused many employees to lose their benefit claim in court. Another point of unfairness is that a court may limit or exclude any evidence that is not in the claim file before a lawsuit is filed in many cases. Long term disability claimants in particular have lost in court by failing to present critical evidence before filing a lawsuit. As a result of this unfairness, it is important for the employee, or the employee's loved ones, to obtain an experienced ERISA attorney to protect rights while the claims process is ongoing and before appeals have concluded.

The Martin Law Group, LLC is focused on employee benefits. The majority of our cases are long-term disability and pension or retirement claims. We have experience handling these cases since 1992. This narrow focus enables us to stay current regarding developments in this area of the law and allows us to pay close attention to the strategies and practices of insurance companies and plan administrators. We have received recognition in Alabama Super Lawyers for 2008 in the area of Employee Benefits, which recognizes only 5% of practicing attorneys in the state of Alabama. It is vital to hire an experienced long-term disability lawyer who regularly handles ERISA cases and regularly litigates against large insurance companies and plan administrators in this difficult and challenging area of employee benefits law. Your long term disability claim, retirement claim or other employee benefit claim is important to you. Protecting it early in the claim process is vital.

There is no fee for your initial consultation. We handle cases on either a contingency fee basis (no recovery-no fee) or on an hourly fee basis, depending on our clients' needs and the case.
